PUBLIC OFER AGREEMENT
on the provision of online booking and sale of bus tickets

1. DEFINITIONS
Ticket (including an electronic ticket) is a travel document of the established form, which gives the right to receive bus transport services, created on the website https://mono-bus.com, and which is sent to the email address specified during ordering, or is issued to the User in any other way.
User - a natural or legal person who receives services and pays for them on the website https://mono-bus.com.
MonoBus – individual entrepreneur Bezhenar Yuriy Mykhailovych (identification number: 2859717315), location: Ukraine, 58000, Chernivtsi region, Chernivtsi city, Golovna str. 190, app 5.
Carrier - a company that directly provides a passenger transportation service, selected, and paid for using the booking and payment system on the website https://mono-bus.com.
Services - services for booking and selling tickets and other services that MonoBus provides to the User in accordance with the terms of this Agreement.
2. GENERAL PROVISIONS
2.1. The public offer agreement (hereinafter referred to as the Agreement) regulates the conditions and procedure for the sale of bus tickets (hereinafter referred to as the Tickets), the rights and obligations arising in this regard for MonoBus and the User.
2.2. Tickets are sold to Users on the terms of this Agreement only in case of its full and unconditional acceptance. Partial acceptance, as well as acceptance on other terms, is not allowed. The use of MonoBus services by the User on the terms proposed in this Agreement indicates the conclusion of this Agreement between them.
2.3. In order to purchase tickets from MonoBus, Users pay for them in accordance with the conditions specified on the website https://mono-bus.com.
2.4. MonoBus has the right to make changes to this Agreement at any time, but in any case, such changes are made public by posting them on the Internet at https://mono-bus.com. The use of MonoBus services by the User after changes to the text of this Agreement means acceptance of the Agreement, taking into account the changes made.
2.5. The terms of this Agreement are valid for all Users.
3. SUBJECT OF THE AGREEMENT
3.1. MonoBus undertakes to provide the User with services for booking and selling tickets using the website https://mono-bus.com and other services, in accordance with the terms of this Agreement (hereinafter referred to as the Services), and the User undertakes to pay at the established cost.
3.2. This Agreement is concluded in accordance with Art. 633 of the Civil Code of Ukraine between MonoBus and the User.
4. ACCEPTANCE OF THE OFFER
4.1. Acceptance (acceptance) of this Agreement is carried out by purchasing a Ticket using the website https://mono-bus.com. The User's acceptance of the provisions of this Agreement is carried out voluntarily and in full.
4.2. By the implementation of the acceptance of this Agreement, the User must be sure that all the terms of this Agreement are clear to him and he accepts them unconditionally and in full.
4.3. By accepting this Agreement, the User confirms that he has the full scope of civil legal capacity, has the appropriate authority to conclude such agreement and is fully aware of the consequence of his actions and in accordance with free will.
5. COST OF SERVICES AND PAYMENT PROCEDURE FOR PURCHASING TICKETS
5.1. The User pays the cost of the Ticket in accordance with the parameters of the User's order on the terms determined on the website https://mono-bus.com.
5.2. The user is obliged to carefully check his choice and the entered data, and then click the "Pay" button. After clicking the "Pay" button, the User proceeds to the payment procedure. On the Payment page, the User fills in the bank card details. Some banks can send an SMS password to the phone specified when issuing a bank card. In this case, for a successful payment, the User must enter the SMS password and press the "Confirm" button. After that, the User will see a message about successful payment, after which the User is redirected to the page with his Ticket. On this page, the User can perform the following actions at his choice: print the Ticket, save the Ticket to his electronic device, or send the Ticket to his email address.
5.3. The User is solely responsible for all commission expenses and other expenses determined by the bank that may be added to the Ticket price.
5.4. Banking services related to the transfer of funds under the Agreement are paid by the party that provides them.
6. RETURN OF TICKETS
6.1. Each Carrier sets its own terms for the return of tickets.
6.2. The terms of ticket refund are posted in the "Personal Account" on the website https://mono-bus.com on the Ticket information page.
7. RIGHTS AND OBLIGATIONS OF THE PARTIES
7.1. The User has the following rights:
7.1.1. To send feedback on MonoBus performance to the provided by MonoBus contacts.
7.1.2. To claim compensation for damage arising from the terms of the Agreement by sending an appropriate appeal to support@mono-bus.com.
7.1.3. To receive from MonoBus the information necessary to order the Services.
7.2. The User is obliged:
7.2.1. To pay in full the cost of MonoBus services.
7.2.2. To read in detail all the terms of this Agreement and accept them when purchasing a Ticket, as well as all additional conditions governing the relations of the Parties under this Agreement.
7.2.3. When placing an order for a Ticket, provide the necessary correct, accurate and complete information necessary for the provision of the Services.
7.2.4. To read the terms and conditions of the selected Carrier for the purchase of the Ticket of the selected Carrier, thereby agreeing to perform and act in accordance with the terms and conditions of the Carrier.
7.3. MonoBus has the following rights:
7.3.1. To require the User to comply with all registration and payment procedures according to the rules set forth in this Agreement.
7.3.2. If the User refuses to accept the terms of this Agreement, refuse to provide services to the User.
7.3.3. To establish and receive additional remuneration from the User for additional services provided.
7.3.4. Record telephone conversations with the User in case of contacting the service center and / or in case of user service and / or the need to inform the user and / or obtain additional information about any Ticket purchased using the website https://mono-bus.com.
7.3.5. Suspend the provision of the Services in connection with the necessary technical and preventive work.
7.4. MonoBus is obliged to:
7.4.1. Send the User a Ticket in accordance with the form established and accepted by the Carrier.
7.4.2. Provide the User with instructions for issuing / paying / receiving the Ticket. Comprehensive information is the information that MonoBus publishes on the website https://mono-bus.com.
7.4.3. Inform the User about the change or cancellation of the run (if such information is received from the Carrier).
7.4.4. Accept an appeal from the User, consider it independently or, if necessary, send it to the appropriate Carrier for consideration.
8. PROCESSING OF PERSONAL DATA
8.1. In accordance with the provisions of the Law of Ukraine "On the Protection of Personal Data" No. 2297-VI dated 01.06.2010, the User acknowledges and agrees to provide MonoBus with his personal data, as well as personal data of third parties specified by the User, obtained by MonoBus in the process of registration Tickets. The processing of the User's personal data is carried out in accordance with the legislation of Ukraine and Privacy Policy. The User gran ts MonoBus the right to process his personal data in connection with the provision of the Services to the User, stipulated by this Agreement.
9. DISPUTE RESOLUTION
9.1. All disputes and disagreements arising in connection with this Agreement shall be resolved through negotiations between the Parties. Pre-trial dispute resolution is mandatory for the Parties. If the parties were unable to resolve any dispute and / or disagreement through negotiations, the Party that believes that its rights have been violated is obliged to send the other Party a pre-trial claim, the consideration of which is 30 (thirty) working days from the date of receipt of the claim. If a response to a claim is not received within 30 (thirty) business days, as well as if a response was received, but did not satisfy the Party that believes that its rights have been violated, such Party has the right to apply to the court in accordance with the rules of jurisdiction established by the legislation of Ukraine and the norms of international law.
10. LIABILITY OF THE PARTIES
10.1. In case of non-fulfillment or improper fulfillment of their obligations, the Parties shall be liable in accordance with the legislation of Ukraine and the terms of this Agreement.
10.2. The User assumes all possible commercial risks associated with actions in the event of errors and inaccuracies in data provided by the User.
10.3. MonoBus is not responsible for any direct, indirect, incidental and punitive damages, as well as for inconveniences associated with the performance of transportation (including, but not limited to, run delays, run cancellations, missed connections) or other possible problems that place in connection with visiting or using the site https://mono-bus.com.
10.4. MonoBus is not responsible for losses and damages incurred by the User while traveling.
10.5. MonoBus is not responsible for the acts, negligence, errors of representatives and warranties of any carrier and / or any injury, death, property damage or other damage or expense resulting from the use of or access to the services and / or goods of the Carrier.
10.6. MonoBus is not responsible for the inconvenience and losses incurred by the User as a result of failure to provide accurate information when using the site https://mono-bus.com, if such information is provided by the Carrier.
10.7. MonoBus is not responsible for losses and / or loss of a Ticket, for losses incurred by the User as a result of the bus being late to the point where the User should have made a transfer, including if the Tickets were purchased in one order through the https://mono-bus.com.
10.8. The user acknowledges that he is fully responsible for the data provided to MonoBus (including to its employees).
10.9. The User acknowledges that he has no claims to MonoBus for the incorrectly placed order by himself, since he was not personally convinced of its correctness.
10.10. The User is solely responsible for maintaining the confidentiality of his own username and password. All actions using the User's login and password are considered to have been carried out by the User personally.
